Have Not Received Payment
All debts of an estate must be addressed before distributing the estate to beneficiaries. If there are not enough assets in an estate to pay all of the debts, the law sets out the priority for payment. See rules 16-16 and 16-24 of The King’s Bench Rules for more information.
If you believe you are owed a debt from an estate but your claim has been denied:
- it is a legal issue that is not within the jurisdiction of the Law Society to review; and
- it can be taken before the courts and you may wish to seek legal advice.
Lawyers and limited licensees generally also have a duty to respond promptly and courteously to communications that require a reply. See section 3.2-1, commentaries [3] and [5] of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
